NBA condemns judge for ordering Sowore’s lawyer to kneel

The Nigerian Bar Association has expressed concern over a reported courtroom incident involving Justice Mohammed Umar, where a defence lawyer was allegedly instructed to kneel during proceedings.

The association described the directive as inconsistent with judicial norms and the dignity of the legal profession.

The incident reportedly occurred in a case involving activist Omoyele Sowore, who faces prosecution by the Department of State Services over alleged cyber-related offences.

Channels Television reported that during the hearing, the presiding judge admonished the defence counsel for his tone and allegedly ordered him to “come out and kneel down” in open court. Other lawyers intervened, after which the judge adjourned the matter.

In a statement on Monday, NBA President Afam Osigwe said the board was concerned about reports that Marshall Abubakar, lead defence counsel for Sowore, was directed to kneel.

“The courtroom is a temple of justice, governed by law, procedure, and decorum,” Osigwe said.

“Judicial authority must always be exercised within established legal limits. A judge directing a legal practitioner to kneel is not a recognised sanction under our laws and does not align with expected standards of judicial conduct.”

The association acknowledged judges’ authority to maintain order but stressed that such powers are not absolute.

“Punishment for contempt must follow clearly defined procedures that ensure fairness and respect for the rights and dignity of all parties,” the statement added.

The NBA also reminded lawyers to exercise restraint and uphold professional decorum, noting that advocacy must always respect proper legal channels.

“Disagreements with the court, no matter how strongly felt, must be expressed within the bounds of courtesy,” it said.

Reacting to the incident on X, Sowore criticised the judge’s action, writing, “HOW DO YOU EXPECT JUSTICE IN A COUNTRY WHERE A JUDGE ORDERS A SOLID LAWYER TO KNEEL DOWN…?” He added that his lawyer maintained his composure throughout the proceedings.

Human rights lawyer Inibehe Effiong also condemned the reported directive, saying, “Corporal punishment has no place in the temple of justice. It is better to face imprisonment than to be compelled to kneel in a courtroom.”

The NBA reaffirmed its commitment to upholding judicial ethics and the rule of law, pledging to engage relevant authorities to preserve the integrity of the legal system.
